I just returned from visiting the newly opened The Signature Residences at the MGM Grand Las Vegas. These pictures were take from Tower 1 on the 25th floor penthouses. More than 1,600 of the 1,727 condominium-hotel suites at The Signature Residences at MGM Grand Las Vegas have been sold since January 2004, and the demand for this lifestyle remains strong.

Sales of the furnished residences are not the only thing progressing rapidly. Construction is on the fast track with The Signature Residences’ first 40-story tower completed and owner escrow closings are happening. Fixed rate mortgage loans generally come with one of two options; the 30-Year Fixed and the 15-Year Fixed loans. If a borrower is planning on being in the same Las Vegas home for a long period of time, a 30-Year Fixed may be more attractive because it offers stability. The monthly payment will remain the same over the life of the loan. If interest rates are at historic lows at the time the borrower is seeking to obtain financing, this is a good loan program to consider.

A 15-Year Fixed rate mortgage loan program offers the same stability, but the accelerated amortization schedule makes the monthly payment substantially higher. While the interest rate may be lower on this type of mortgage loan, the borrower must be willing to commit to a higher monthly payment. If the borrower wishes to retire in 15 years and be debt-free at that time, this loan program may be more suitable to the borrower's long-term Las Vegas real estate loan needs.

Pre-payments are possible on a 30-Year loan and reduce the life of the mortgage loan, as well as the interest payment, without committing to the higher monthly payment of a 15-Year program. As long as there is no pre-payment penalty associated with the 30-Year fixed rate mortgage loan, pre-payment offers the borrower the option to make additional loan payments when it is affordable. If cash flow becomes difficult, this mortgage loan will not put the borrower in a compromising position, possibly loosing their hard earned Las Vegas real estate.

Process for a Las Vegas Home Appraisal

Consumers are often baffled by the home appraisal Las Vegas process. They may feel their home is worth a certain dollar amount, and therefore, the appraised value doesn't make sense to them. It is important to know that appraisal guidelines are dictated by the mortgage lenders. In many states, including Nevada, the mortgage lenders must disclose the purpose of the appraisal, as each situation carries its own set of rules, from San Diego to Miami.

In essence, lender guidelines force appraisers to put a fair market value on a home based upon comparable sales in the area where the Las Vegas home is located, as the home must be bracketed according to size and value. For example, there is no set amount associated with a great view, pool, spa, bathroom upgrades, etc. If a homeowner installs a custom pool that cost them $30,000, and the local marketplace, Las Vegas, supports the value of a pool at $15,000, that item will be bracketed as [$15,000] on the appraisal.

Upgrades can usually be expressed at full value in newer homes since they required investing additional money onto the cost of building the home. On the other hand, the amount invested in upgrading or remodeling an older home is rarely reflected in full in the final home appraisal. The reason is the home had value in its original condition, and again, the value of the upgrades must be supported by comparable examples within the same Las Vegas marketplace.

These comparisons must be drawn from current market activity within the last six months. Some mortgage lenders may want to look at both closed and pending real estate sales to see if there is any room for negotiation. This is a safeguard to prevent appraisers from over-valuing the Las Vegas home in question. It is further stated in the guidelines that appraisers can only place a value on homes that have closed escrow. However, when property values rapidly increase within a marketplace, appraisers are generally permitted to make concessions and put more weight on the evidence provided by comparisons to pending real estate sales and listings. This allows for a "real time" home appraisal.

You may have seen some of these new online companies that will give you a free online home appraisal but the mortgage lenders will not give weight to this information. They want a company that is familiar with the local area and that can appraise the Las Vegas real estate.

Although there is no formal standard to speak of, most lenders give the appraiser a 5% margin of error. If the file is reviewed and the home appraiser is off by 8%, there is a good chance the value will be cut by the full 8%. It is in the best interest of both the appraiser and the homeowner not to push the value up higher than the market will support, otherwise the property evaluation may be exposed to a strict home appraisal review.

Centex Destination Properties has started development on the $1.5 billion, 2,400-unit "Urban Village" mixed-use project on Las Vegas Boulevard South, between Pyle and Frias avenues. The development firm purchased the 50-acre Las Vegas real estate site and project plans from Diversified Real Estate Group in December.

Las Vegas county records show that Centex paid $35 million for 13.59 acres being used for the first phase, or $2.575 million per acre. Diversified, by contrast, purchased the entire site in 2004 for $34.8 million, or $696,000 per acre, county records show. Reservations for the initial brownstones have been initiated. The brownstone and master plan theme are similar to Diversified's original plan, but the finishes and amenities package have been upgraded.

The first condo units, including brownstones, range from 938 to 2,225 square feet in size, with prices from $375,000 to $795,000. Las Vegas single-family homes, by comparison, averaged 2,223 square feet in February.

Urban Village will consist of five neighborhoods with buildings up to 12 stories, flats, live-work spaces, housing a combination of brownstones, lofts and condo-hotel units. The project additionally will offer restaurants, fitness center, shops, a pool complex, jogging paths and parks. Other features call for pet stations, rose gardens secured parking, outdoor grills and a bocci court. The finished Las Vegas condo Urban Village development, including brownstones, is expected to be finished in eight years.

Title is the legal documentation that bestows ownership of real property hopefully in Las Vegas. This is to be indicated in Part II of the 1003 Uniform Residential Loan Application as "manner in which title will be held."

The decision of how the title will be held should be considered first since it has a great impact on future tax planning, the financial future of the borrower(s) and their respective heirs, and the choice of the Las Vegas real estate lender.

It is most important for the Las Vegas mortgage consultant to work hand-in-hand with the Las Vegas home borrower's financial planner or tax consultant to assist their mutual client in order to make decisions that work best for their financial situation.

Joint Tenancy For example, most married couples would consider holding title with Joint Tenancy. But if one spouse has a good credit history while the other has damaged credit that may prevent funding of the Las Vegas real estate loan, it would be advantageous to make a real estate home title transfer in the name of the spouse with the good credit rating. When a married person takes title to real property in his or her name alone in sole ownership, the spouse is usually asked to sign a quitclaim deed giving up any ownership interest in the Las Vegas property.

Living Trust Probably the best way to hold title to homes and other real property is in a revocable living trust. There are many advantages including avoidance of probate costs and delays.

Most living trusts cost less than $1,000 and deeding real property into the living trust, there are no disadvantages.

Until the death or disability of the trust creator, the Las Vegas home and other real estate in the living trust are treated normally.

Since the living trust is revocable, these assets can be sold, bought and financed.

When the trustor dies, the assets are distributed according to the trust's terms.

Privacy is a major advantage. Unlike a will, which becomes part of the public probate file, the living trust terms remain private.

Tenants in Common When two or more co-owners take title to Las Vegas real estate, especially if they are not married to each other, they often become tenants in common.

Each tenant in common owns a specified interest in the Las Vegas property. It doesn’t need to be equal. For example, one owner might own a 60% interest, another could own a 10% interest and a third tenant in common could own a 30% share. The percentage ownership is specified on the deed.

Common ways to hold title are broken down into options that fall under the categories of sole ownership or co-ownership. Many states permit the holding of title in a living trust, but some lenders do not accept those terms. There are ways around this, but this is where the Las Vegas financial planner and the mortgage planner can make a tremendous difference by working together for the good of the Las Vegas real estate owner.

As Las Vegas land prices rise and available terrain shrinks, Las Vegas residential developers are building like Chicago and New York, building up rather than out.

Half-dozen Las Vegas real estate developers are now trying their hand at three-story Las Vegas homes in Southern Nevada, according to Dennis Smith, president of Homebuilders Research.

President Tom McCormick, of Astoria Homes, was a trendsetter for three-story Las Vegas homes. He began building his first three-story homes in late 2005, as part of its 1,254-home Tapestry development in Centennial Hills, which 150 to 200 three-story residences will be included in the three-neighborhood project. The Las Vegas neighborhoods will be called the "Avenues," "Courts" and "Lanes." Of those homes, 480 homes in the "Lanes" neighborhood will include the tri-level product.

McCormick states that the three-story Las Vegas homes are selling quickly and is adding the Hillside development, in the Lone Mountain area. The homes will have over 150 three-story products in the community.

These three-story homes cost about 25 percent less because smaller lots are used, than a single story 2,100 to 2,200 square foot home in Tapestry costing $400,000.

KB Home builder in Las Vegas is following suit in its planned Apple Creek Village in the builder's Sierra Ranch development located in northwest Las Vegas. The village will include 11 three-story homes near Ann Road and Commerce. The Alturas community in Mountain's Edge, KB Home offers five different styles of three-story plans. These three-story homes start at $308,000. Three-story attached brownstones are slated for KB Home's Oxford Commons community in northwest's Providence development. Another three-story home is scheduled for Henderson's 2,000-acre Inspirada. The Henderson city planners have hailed this Las Vegas home development as the "New Urbanism.”

The Las Vegas lender must disclose a good faith estimate of all settlement costs in a Las Vegas real estate transaction. A check to cover your closing costs will probably have to be a cashier’s check. The Las Vegas title company or other entity conducting the closing will tell you the required amount for:

• Downpayment
• Loan origination fees
• Points, or loan discount fees, you pay to receive a lower interest rate
• Appraisal fee for the Las Vegas real estate
• Credit report
• Private mortgage insurance premium
• Insurance escrow for homeowners insurance, if being paid as part of the mortgage

A Note About Prorations: Because such costs are usually paid on either a monthly or yearly basis, you might have to pay a bill for services used by the sellers before they moved. Proration is a way for the Las Vegas home sellers to pay you back or for you to pay them for bills they may have paid in advance. For example, the Las Vegas gas company usually sends a bill each month for the gas used during the previous month. But assume you buy the home on the 6th of the month. You would owe the gas company for only the days from the 6th to the end for the month. The seller would owe for the first five days. The bill would be prorated for the number of days in the month, and then each person would be responsible for the days of his or her ownership of the Las Vegas real estate.
